1. Introduction
These Terms & Conditions govern access to and use of PillarWise, an AI-powered employee training and workplace support platform.
By creating an account, purchasing a subscription, accepting an invitation to a PillarWise workspace or otherwise using the platform, you agree to these Terms.
If you use PillarWise on behalf of a business or organisation, you represent that you have authority to act on its behalf where required.
2. About PillarWise
PillarWise allows businesses to upload workplace documents, create AI-assisted training content and quizzes, assign training, monitor employee progress and provide staff with AI-assisted answers based on workplace information.
Features may be added, modified, improved or removed as the platform develops.
3. Accounts and Security
You must provide accurate information when creating or using an account and keep your account details reasonably up to date.
You are responsible for maintaining the confidentiality and security of your login credentials and for activity carried out through your account, except to the extent that activity results from a failure for which PillarWise is legally responsible.
You must notify us promptly if you believe your account has been compromised or accessed without authorisation.
4. Managers and Employee Accounts
Managers may invite employees or other authorised personnel to their PillarWise workspace and may assign training and view relevant training records.
Businesses are responsible for ensuring they have the necessary authority to provide employee information to PillarWise and to use the platform in connection with their personnel.
Workspace owners and managers are responsible for managing access to their workspace, including removing access when it is no longer appropriate.
5. Customer Content
Customers retain ownership of documents, manuals, policies, procedures, menus, training materials and other content they upload or submit to PillarWise.
By uploading or submitting content, you grant PillarWise a limited, non-exclusive licence to host, store, copy, process and use that content only as reasonably necessary to provide, maintain, secure and support the PillarWise service.
You are responsible for ensuring that you own your content or otherwise have the rights and permissions necessary to upload, use and process it through PillarWise.
6. PillarWise Intellectual Property
PillarWise and its associated software, website, branding, designs, interfaces, technology and original materials are owned by or licensed to PillarWise and are protected by applicable intellectual property laws.
Except as permitted by law or expressly authorised by us, you may not copy, reproduce, sell, sublicense, reverse engineer or commercially exploit PillarWise or its proprietary technology.
7. AI-Generated Content
PillarWise uses artificial intelligence to assist with features including training generation, quiz generation and staff assistance.
AI-generated material may occasionally be incomplete, inaccurate or unsuitable for a particular workplace or situation.
Customers remain responsible for reviewing AI-generated training materials and ensuring that workplace information, procedures and instructions used through PillarWise are accurate, appropriate and up to date.
PillarWise should not be used as a substitute for professional, legal, medical, safety or other specialist advice where such advice is required.
8. Training Responsibilities
PillarWise is a training and workplace support tool. It does not replace an employer's responsibility to provide appropriate supervision, workplace instruction, legally required training or any licences, certifications or safety training required for a particular role.
Customers are responsible for determining whether training provided through PillarWise is suitable for their workplace and employees.
9. Acceptable Use
You must not use PillarWise to:
- Engage in unlawful, fraudulent or abusive activity.
- Upload content you do not have the right or permission to use.
- Upload malicious software, harmful code or material intended to interfere with the platform.
- Attempt to gain unauthorised access to accounts, systems, databases or other workspaces.
- Circumvent security controls, subscription restrictions or usage limitations.
- Use automated methods to scrape, extract or copy substantial parts of PillarWise without permission.
- Use the platform in a way that materially interferes with its operation or other users.
10. Subscription Plans
PillarWise may offer monthly, annual or other subscription plans. The features, limits and pricing associated with each plan will be displayed at the time of purchase or otherwise communicated to the customer.
Certain features or usage levels may only be available on particular plans.
Unless otherwise stated at checkout, subscriptions renew automatically at the applicable billing interval until cancelled.
11. Payments
Subscription payments may be processed by third-party payment providers such as Stripe.
By purchasing a subscription, you authorise the applicable subscription charges disclosed at checkout to be charged using your selected payment method in accordance with your billing cycle.
Prices, applicable taxes and billing frequency will be displayed before purchase.
12. Free Trials and Promotions
PillarWise may offer free trials, discounts or promotional offers from time to time. Eligibility, duration and conditions may vary and will be communicated with the relevant offer.
Promotional offers may be modified or withdrawn where permitted by law, provided this does not affect rights already acquired under an accepted offer.
13. Cancellation
Customers may cancel their subscription through the available billing management tools or by contacting PillarWise where appropriate.
Unless otherwise stated or required by law, cancellation stops future renewal and the subscription remains available until the end of the current paid billing period.
Cancellation does not automatically entitle a customer to a refund for amounts already paid, subject always to rights and remedies available under applicable law.
14. Refunds and Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including rights that may apply under the Australian Consumer Law.
PillarWise does not generally provide refunds solely because a customer changes their mind about a subscription.
Where a customer is entitled to a refund, remedy or other right under applicable law, PillarWise will provide the remedy required by that law.
15. Service Availability and Maintenance
We aim to provide a reliable service but do not guarantee that PillarWise will always be available, uninterrupted or error-free.
Access may occasionally be interrupted due to maintenance, upgrades, security work, technical problems, third-party service failures or circumstances outside our reasonable control.
Where reasonably practicable, we may provide notice of planned maintenance that is expected to materially affect access to the service.
16. Third-Party Services
PillarWise relies on third-party services for certain functionality, including infrastructure, authentication, data storage, artificial intelligence and payment processing.
Third-party services may be subject to their own terms, policies and availability. PillarWise is not responsible for third-party services to the extent permitted by law, except where liability cannot lawfully be excluded.
17. Suspension and Termination
We may suspend or terminate access where reasonably necessary due to non-payment, material breach of these Terms, unlawful use, security threats, fraud, abuse of the platform or conduct that materially risks harm to PillarWise, its users or third parties.
Where appropriate and reasonably practicable, we may provide an opportunity to address the issue before termination.
18. Data Following Termination
Following account or workspace termination, access to customer content and account information may cease.
Information may be retained for a reasonable period where necessary for legal, security, backup, billing, dispute resolution or operational purposes before being deleted or de-identified in accordance with our Privacy Policy and applicable law.
19. Limitation of Liability
To the maximum extent permitted by law, PillarWise is not responsible for loss caused by inaccurate, incomplete, outdated or unauthorised customer-provided information, or by a customer's failure to appropriately review training materials, AI-generated content or workplace procedures.
PillarWise does not exclude or limit liability where doing so would be unlawful, including liability arising under rights or guarantees that cannot legally be excluded.
20. Changes to PillarWise and These Terms
We may update PillarWise and these Terms as the service develops, business practices change or legal requirements evolve.
The current Terms will be published on our website with an updated "Last updated" date. Where appropriate, we may provide additional notice of material changes.
21. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Nothing in this section limits any rights you may have under laws that apply regardless of this choice of law.
